These terms govern your use of papat (“the Service”), provided by Murayama Photo Office (“we”). The Japanese version is the governing text; this translation is for convenience.
The Service
Photographers (“you”) upload photos to galleries that the people you invite (“viewers”) can open in a browser to pick, rate, comment on and download photos.
Accounts
You sign in with your email address or Google account and are responsible for keeping access to it secure.
Fees and payment
- Fees are as listed on our pricing page. Usage is billed monthly to your registered card; months without usage are not billed.
- Your first 3 galleries require no card.
- Fees paid are non-refundable except where required by law. We will notify you in advance of any price change.
Your photos
- You (or the rightful owner) keep all rights to your photos. We handle them only as needed to run the Service (storing, displaying, delivering, generating resized copies).
- We never use your photos to train machine-learning or AI models, and never share them with third parties except as required by law.
- When a gallery expires, its photos and data are deleted permanently. Keep your own copies.
- You confirm you have the rights and consents (including from people pictured) needed to share your photos with viewers.
Prohibited use
Illegal content; infringing others’ copyright, likeness or privacy; overloading or attacking the Service; using it as general file hosting; anything else we reasonably consider inappropriate. We may suspend galleries or accounts that break these terms.
Changes and termination
We may change, pause or end the Service, with reasonable advance notice before ending it.
Liability
The Service is provided as is. Except for our intent or gross negligence, we are not liable for damages; any liability is capped at the fees you paid in the month the damage occurred.
Governing law
Japanese law governs these terms; disputes go to the Tokyo District Court as the court of first instance with exclusive jurisdiction.
